Flybaboo SA (hereinafter “Flybaboo”) is a Swiss aviation company carrying passengers on regional commercial routes. Its registered office is 46 rue de Frontenex, 1207 Geneva. Flybaboo is duly authorized by the Federal Office for Civil Aviation to operate flights in Switzerland. These Terms and Conditions of Carriage apply to all flights operated by Flybaboo SA.
Article 1: Definition
1.1 Carrier
“Carrier” means Flybaboo;
1.2 Baggage
“Baggage” means your personal property accompanying you in connection with your flight;
1.3 Booking Reference (PNR)
“Booking Reference” means the reference you are given by us to identify your flight reservation;
1.4 Convention
“Convention” means whichever of the following applicable conventions:
- The Convention for the Unification of Certain Rules relating to International Carriage by Air, signed in Warsaw on 12 October 1929 (the “Warsaw Convention”) and amendments related thereto;
- The Convention Supplementary to the Warsaw Convention for the Unification of Certain Rules Relating to International Carriage by Air Performed by a Person other than the Contracting Carrier, signed in Guadalajara on 18 September 1961 (the “Guadalajara Convention”);
- The Convention for the Unification of Certain Rules for International Carriage by Air, signed in Montreal on 28 May 1999 (the “Montreal Convention”);
1.5 Damage
“Damage” includes death, wounding or bodily injury to a Passenger, and loss, partial loss, theft or other damage to Baggage arising from or in connection with carriage or associated services performed by us;
1.6 Passenger or You (your / yourself)
“Passenger” and “you” are equivalent and mean any person carried or to be carried in an aircraft following the purchase of a ticket;
1.7 Special Drawing Rights (SDRs)
“Special Drawing Rights” means the unit of currency defined by the International Monetary Fund;
1.8 Ticket
“Ticket” means the confirmation of flight details, including the Booking Reference, as well as the conditions of contract and the Boarding Pass issued at check-in;
1.9 Terms and Conditions of Carriage “Terms and Conditions of Carriage” means the present Terms and Conditions of Carriage
1.10 We (our / ourselves / us)
“We” means Flybaboo.
Article 2: Applicability

2.1 General
These Terms and Conditions of Carriage apply to all flights performed by us subject to Articles 2.2.
2.2 Overriding Laws
Should the Terms and Conditions of Carriage or any part of them be inconsistent with any compulsory laws, including Convention, which apply to our contract of carriage, those laws will apply.
Article 3: Tickets

3.1 Contract of carriage
The Ticket is evidence of the contract of carriage concluded between you and us. The terms and conditions of this contract of carriage are constituted of the Ticket and these Terms and Conditions of Carriage. Copies thereof may also be obtained from us on request.
3.2 Validity
Tickets are not transferable. A ticket is only valid for the Passenger(s) named and the flight specified in the reservation originally made or as subsequently changed and accepted by us in accordance with Article 5.2.
Article 4: Fares

4.1 General
Fares apply only for carriage from the airport of origin to the airport of destination. Fares do not include ground transport services between airports, and between airports and town terminals.
4.2 Tariffs
Fares will be calculated in accordance with our tariffs in effect on the date of the payment of the Ticket for the flight concerned. Should you wish to change your flight, there may be additional payments due as provided in Article 5.2.
4.3 Taxes and Charges
Any taxes or charges imposed by the government or any other authorities, including charges imposed by operating airports, in respect of you and/or your flight, are payable by you to us in addition to the fares. The said taxes and charges are regularly changed by the government and any other authorities and can be imposed after the reservation date. If any such tax or charge is introduced or increased after the reservation was made, you will be obliged to pay it prior to departure. Similarly, if any such tax or charge due is abolished or reduced before we are obliged to pay it, you will be entitled to claim a refund from us.
4.4 Credit card charges
A lump sum charge to cover credit card charges is payable by you. The amount of such a lump sum charge is indicated on the website and mentioned on the reservation confirmation.
4.5 Indicated price upon reservation
At the time you make a reservation, the price indicated for every flight already comprises the taxes and charges imposed and payable by you, according to Article 4.3, as well as credit card charges, according to Article 4.4.
4.6 Currency
Fares, taxes and charges are payable in the currency in which the price is published unless otherwise agreed by us.
Article 5: Reservations

5.1 Reservation requirements
A reservation for a particular flight is confirmed by the issuance of a Booking Reference. There is no need to reconfirm a flight prior to check-in.

5.3 Payment
Fares, plus all taxes and charges relating to your reservation, must be paid in full upon confirmation of reservation. If such sums have not been paid in full when a reservation is confirmed, we may cancel the reservation at any time prior to check-in.
5.4 Data protection
You acknowledge that your personal data has been given to us for the following purposes: making a reservation for carriage and providing you with confirmation of that reservation, providing and developing ancillary services and facilities, direct marketing (subject to your right to withdraw your authority), checking credit cards or other payment cards, execution of trip formalities including communication to competent authorities. For these purposes, you authorize us to retain and use your personal data and to transmit it to our offices, authorized agents, government agencies, other associated carriers or the providers of services mentioned above.
5.5 Seating
We do not guarantee to provide any particular seat in the aircraft. You agree to accept any seat that may be allotted or is otherwise made available on the flight.
5.6 No refund
The Fares and credit card charges will not be refunded by us if you fail to use the seat for which a reservation was made.
5.7 Stopover
Stopovers may be permitted at stopping places specified in the Ticket and shown in our timetable.
5.8 Enjoy carrying your ski equipment on board for free
Restricted to one ski equipment per person; equipment (skis, poles and boots) must be stored in an appropriate bag.
Article 6: Passengers

6.1 Pregnant Women
We do not accept pregnant women as from the 28th week of pregnancy without a medical certificate confirming that the passenger is fit to fly. We do not accept women pregnant for more than 32 weeks.
6.2 Children
We do not accept unaccompanied minors under 12 years of age. Minors under 12 years of age shall be accompanied by a passenger aged of 18 years of age at least or by a family member of 16 years of age at least.
6.3 Disabled Passengers or Passengers with special needs
Disabled passengers or passengers with special needs will be accepted, subject to prior notice to us at the time of reservation.Flybaboo will transport clients with reduced mobility regardless of their type
6.4 Flybaboo assists customers with disabilities, if requested at time of booking
This assistance must be booked in advance through our Booking Centre on 848 445 445.
6.5 Assistance
Assistance for children, disabled passengers and passengers with special needs may be provided upon request to us at the time of reservation. The fees for such an assistance depend on the type of assistance required and the concerned airports and will be payable by you.
6.6 Right to refuse carriage
We may refuse to carry you or your Baggage on our flights, if we determine in the exercise of our reasonable discretion that: (a) such action is necessary for safety reasons; (b) such action is necessary in order to comply with any applicable laws, regulations or provisions; (c) your current state, including the influence of alcohol or drugs, present a hazard to yourself, to other passengers or our crew; (d) you have committed misconduct on a previous flight; (e) you have not paid the applicable fare, taxes and charges.
6.7 Conduct aboard aircraft
Should you behave aboard aircraft so as to endanger the aircraft or any person or any property, or fail to comply with any instructions of the crew, or use threatening, abusive or insulting words towards our crew or other passengers, or act in an appropriate, threatening or insulting manner towards our crew or other passengers, we may take such measures as we deem necessary to prevent continuation of such conduct, including restraint. For safety and security reasons, the use of electronic equipments, such as mobile phones, computers, CD and DVD players, electronic games, is prohibited from use aboard, except hearing aids and pacemakers.
Article 7: Check-in and Administrative Formalities

7.1 Check-in deadlines
You must arrive at the airport sufficiently in advance of the scheduled flight departure time to permit completion of Government formalities and check-in procedures. Check-in will normally start one hour (1h) prior to the scheduled time of your flight. If you fail to present yourself for check-in 45 minutes prior to the scheduled time of your flight, or appear to be improperly documented and not ready to travel, we may refuse to carry you and we are not liable for any losses or expenses ensuing from your failure to comply with the provisions of this Article. Should we refuse you due your late presentation for check-in, you will not be entitled to a refund or a transfer to another flight.
7.2 Requirement for check-in
On check-in you are required to present the Booking Reference of your flight which you have reserved with us.
7.3 Valid travel documents
You are required to hold on check-in for all flights, even Swiss domestic flights, valid travel documents for Switzerland and countries parties to the Schengen Agreement. We may but have no obligation to verify the validity of your travel documents. We may refuse to check you in especially due to risks of diversion of the flight via an airport outside Switzerland. Should you not be able to check in for not having valid travel documents, you are not entitled to any refund or to transfer your reservation to another flight. Moreover, should you have been allowed to check-in but prevented from proceeding further by customs or immigration authorities at any stage of the journey or to pass the passport control at destination, you are not entitled to any refund and you shall be liable towards us of all costs resulting from your inability to proceed with the journey for which you have made a reservation.
Article 8: Baggage

8.1 Checked Baggage
Each Passenger is permitted to transport, free of charge, up to 2 standard
pieces of checked baggage up to a maximum aggregate weight of 20 kg for booking classes X,I,K,Q,H,B,L,M,V,U,N,T,R,G,W,Z and 3 standard pieces of checked baggage up to a maximum aggregate weight of 30 kg for classes S,D,A. Upon delivery to us of a baggage to be checked, we shall take custody thereof and issue a baggage identification tag for each piece of checked Baggage.
8.2 Unchecked Baggage
Each Passenger is permitted to transport, free of charge, one standard
piece of hand baggage up to a maximum weight of 8 kg for, dimensions
55x40x20cm. for booking classes X,I,K,Q,H,B,L,M,V,U,N,T,R,G,W,Z and up to two standard pieces of hand baggage up to a maximum weight of 8 kg, dimensions 55x40x20cm, for classes S,D,A. We may refuse to accept excess Baggage in our discretion. We advise that you notify us in advance if you intend to transport excess Baggage especially if bulky.
8.3 Excess Baggage You will be required to pay an additional fee, in an amount of CHF 10.- per kilo, for the carriage of Baggage in excess of the Baggage specified as provided in Articles 8.1 and 8.2.
8.4 Items as unacceptable Baggage
We may refuse to accept Baggage for carriage unless, in our reasonable opinion, properly packed in suitcases or other suitable containers to ensure safe carriage and we may refuse to further carry any such items if discovered. You must not include in your Baggage items which might endanger the aircraft or persons or property aboard the aircraft, including those specified in the Dangerous Goods Regulations of the International Air Transport Association (IATO) and the Technical Instructions for the Safe Transport of Dangerous Goods by Air of the International Civil Aviation Organisation (ICAO). Likewise you must not include in your Baggage items which are prohibited by the applicable laws and provisions of the place of departure or destination. Firearms, explosives, radioactive materials, flammable products, gas, infectious substances, and similar dangerous items (in the exercise of our reasonable discretion) are not permitted as Baggage. Firearms and ammunition for hunting and sporting purposes may only be carried as Checked Baggage, if declared at check-in and securely packed in accordance with standard IATO and ICAO regulations. Weapons such as swords, knives and similar objects may be accepted at our discretion as Checked Baggage only. Your Checked Baggage must not include fragile or perishable items, money, securities, valuable of any kind, jewelry, computers, electronic devices, business documents, passports and other identification documents. We may not be liable for any loss or damages to such items. The carriage of animals is prohibited. Pets can be carried subject to prior notice at the time of reservation, possession of valid health certificates and permits. The carriage of human remains is prohibited.
8.5 Right of search
For safety and security reasons, we may request that you permit a search, x-ray or other type of scan to be made of your person and your Baggage. Your Baggage may also be searched in your absence. If you are unwilling to comply with such request, we may refuse to carry your or your Baggage without refund or other liability.
8.6 Collection of Baggage
You shall collect your checked Baggage as soon as available at the place of destination. We may charge a storage fee if you do not collect it within a reasonable time. If checked Baggage is not claimed within three months of it being made available, we may dispose of it without any liability towards you.
8.7 Revision to Security Regulation on Cabin Baggage
IMPORTANT
The following information affects all ERA member airlines operating within, into and from the EU. It will be
introduced at very short notice leaving airlines and airports very little time to adapt to logistical and
facilitation problems.
The new rules are likely to introduce further short-term confusion in passengers' understanding of requirements and could easily provoke adverse passenger reactions and further extensive delays. For example, passengers that purchase duty free ‘liquid’ goods outside the EU but who intend to transfer within the EU on to any destination will have their ‘liquid’ duty free purchases confiscated if carried as hand baggage.
It is vital that all aircrew, passenger handling and other relevant ground staff are made aware of these newrequirements.
On 10th August this year an apparent plot to set off bombs on aircraft flying to the United States using liquid explosives was discovered. The European Commission has now acted to restrict all liquids that passengers can carry past screening points and then on-board aircraft. The new regulation EU 1546/2006 restricts liquids that passengers can carry past screening points, whether on their persons or in their cabin baggage and will be effective
from Monday 06th November 2006.
The Regulation applies to all flights departing from airports in the European Union (plus Norway and Switzerland)
regardless of their destination and the nationality of the carrier, so that there is the same level of protection
throughout the European Union. The regulation affects cabin baggage only, as checked hold baggage is
inaccessible in flight.
Furthermore, the new rules will require passengers to remove coats and jackets at security checkpoints and for laptops and large electrical items to be removed from cabin baggage for separate screening.
Finally the Regulation will, within 6 months, limit the size of cabin baggage allowed to a maximum of 56 cm x 45 cm x 25 cm, with the possibilities for some exemptions eg for musical instruments etc. Wheelchairs, prams and pushchairs that are being used by passengers will be permitted, provided they are subject to appropriate screening HOWEVER the implementing Regulation has been amended to allow staff, including flight crew, to take liquids and oversized cabin bags into the security restricted area (SRA) of an airport or on to aircraft. Staff will, of course, still be subject to screening when entering critical parts of SRA.
The future requirement concerning the size of cabin baggage (from May 2007) will not limit the number of bags taken by a passenger as cabin baggage.
NOTE that this regulation is without prejudice to the right of individual Member States to set additional restrictions to these rules as 'more stringent measures', based on their own threat assessments, for example, those currently required for flights departing the UK.
Summary of details: the new rules apply to all liquids, as present-day screening equipment cannot distinguish one type of liquid from another sufficiently fast for it to be used at airports.
Passengers will be permitted to take quantities too small to make dangerous explosives (in containers not exceeding 100 millilitres in capacity) past screening points. They can therefore still carry small amounts of toiletries and perfume in their cabin baggage. The new regulation also makes an exception for medicines and dietary requirements needed during a trip, including baby food. Passengers can continue to carry them in their cabin baggage.
Passengers can also continue to take liquids, such as drinks and perfumes, obtained beyond the points where boarding passes are controlled, on board aircraft. The regulation lays down precautions to prevent tampering or interference after purchase.
Passengers have to pack any limited quantities of liquids in hand baggage and present them at screening points as follows:
Articles defined as ‘liquids’ must be presented in individual containers with a capacity not greater than 100 millilitres or equivalent, and contained in one transparent re-sealable plastic bag of a capacity not exceeding 1 litre (approximately 20cm x 20cm in size)
The contents of each individual container in the plastic bag shall be clearly visible to the screener and the bag shall be completely closed and sealed Liquids include gels, liquid mascara and liquid lipsticks, pastes, lotions, liquid/solid mixtures (eg yoghurt,fromage frais and runny cheese) and the contents of pressurised containers, eg toothpaste, hair gel, drinks,soups, syrups, perfume, shaving foam, aerosols and other items of similar consistency.
This list is notexhaustive and will continually be developed.
Exemptions may be granted if the liquid is:
1 to be used during the trip and is either required for medical purposes or a special dietary requirement, including baby food. When requested to do the passenger shall provide proof of authenticity of the exempted liquid.
2 obtained airside beyond the point where boarding passes are controlled from outlets that are subject to approved security procedures as part of the airport security programme, on condition that the liquid is packed in a bag that is both tamper evident and displays satisfactory proof of purchase at that airport on that day
3 obtained in the security restricted area from outlets that are subject to approved security procedures as part of the airport security programme
4 obtained at another Community airport, on condition that the liquid is packed in a bag that is both tamper evident and displays satisfactory proof of purchase at airside at that airport on that day
5 obtained on board an aircraft of a Community air carrier, on condition that the liquid is packed in a bag that is both tamper evident and displays satisfactory proof of purchase on board that aircraft on that day
A restricted DGTREN paper ‘Understanding Regulation 1546/2006’ will be sent to all ERA member airline and airport security contacts by the Directorate and draft information for passengers is currently under preparation by ACI Europe and AEA and will be forwarded in due course
Article 9: Schedules and Cancellation of flights

9.1 Schedules
We will endeavour to carry you and your baggage with reasonable dispatch, subject to the other provisions of this article, to adhere to published schedules in effect on date of travel. Times shown in timetables, schedules or elsewhere are not guaranteed and do not form part of the contract of carriage.
9.2 Cancellation of flights
We may cancel any flight at anytime after a reservation has been made, if we considered this to be justified by circumstances beyond our control and for safety reasons. We particularly draw your attention to the fact that GVA-LUG flights are regularly cancelled due to meteorological conditions, particularly in winter season. In the event of cancellation of flight, we will transfer your seat to the next available flight to the same destination (subject to space availability). There will be no refund of fares.
9.3 Diversion
In the event of diversion, we will arrange for you to be traveled (at our cost) to the destination airport to which the flight was intended to land. Should you fail to use any means of transport provided by us upon arrival of the diverted flight, you will not be entitled to a later transport at our cost.
Article 10: Compensation for overbooking

10.1 General
As a general policy, we do not overbook our flights, i.e. we do not issue more tickets than available seats. However, due to possible technical problems with our computerized system, such overbooking may occur. Should we have to refuse carriage as a result of such overbooking, you will receive compensation provided (a) you hold a properly-issued ticket, (b) you have paid your fares, taxes and charges relating to your reservation, and (c) you reported to check-in within the specified time.
10.2 Priorities in the event of overbooking
We may seek passengers prepared not to board in return of an appropriate compensation. When assigning the seats available on an overbooked flight, we will give priority to unaccompanied minors and to sick or handicapped passengers. We will assign seats to the remaining passengers in the order in which they checked in for the flight, subject to other non-discriminatory criteria or legitimate reason.
Article 11: refunds

11.1 General
In no circumstances have you the right to obtain any refund of fares and credit card charges, subject to Article 10. However if we consider it justified, at our sole discretion, we may refund the fares and credit card charges in full or in part, or transfer your reservation to another flight.
11.2 Taxes and charges
If you do not fly with us after having made a reservation, you will be entitled to claim a refund of any taxes or charges paid in accordance with article 4.3 which may not be due as a result of not having made the flight. We reserve the right to deduct a reasonable service charge from any refund in case you fail to use your seat despite the availability of your flight. A corresponding claim shall be made within 30 days as from the date of the intended flight.
Article 12: Liability for damages

12.1 General
In respect of international carriage as defined by the Convention, the liability rules of the Convention shall apply. Swiss law provisions shall apply to Swiss domestic flights. Unless specified otherwise in these Terms and conditions of Carriage, we shall be liable to you only for recoverable compensatory Damages for proven losses, in accordance with the Convention or any applicable law. Any liability incurred by us for Damage will be reduced in accordance with applicable law if we prove that you caused or contributed to the Damage. We are not liable for Damage arising from the compliance with legal or official provisions or instructions. We are not liable for any illness, injury or death attributable to your existing physical condition. Nothing in the Terms and Conditions of Carriage shall be interpreted as a waiver of any exclusion or limitation of our liability under the Convention or Swiss law.
12.2 Damage to Baggage and delay
We are liable for Damage to checked Baggage and for delay of Baggage in accordance with the Convention. We are only liable for Damage to unchecked Baggage if this Damage has been caused by our fault or negligence. In case of Damage to checked Baggage, our liability will be limited to a maximum of 17 SDRs per kilogram. In case of Damage to unchecked Baggage, our liability will be limited to a maximum of 332 SDRs per passenger. If other liability limits are specified by the applicable law, these other limits will apply. If we are liable in accordance with the Montreal Convention, our liability for checked and unchecked Baggage will be limited to 1’000 SDRs per passenger. If the weight of Baggage was not recorded when it was checked, it is presumed that the total weight of the checked Baggage did not exceed the applicable free Baggage allowance. In the case of checked Baggage of a higher value declared to us at check-in and subject to the payment of any supplementary charge required by us, our liability shall be limited to such higher value. If we are liable in accordance with the Montreal Convention, in the case of Damage caused by delay, our liability is limited to 4’150 SDRs per passenger.

12.3 Personal Damage
We are liable for your death, injury or other bodily injury in accordance with the terms of the Convention. We hereby confirm that we have liability insurance cover per passenger of at least 100’000 SDRs and not less than the minimum amount required by the Swiss Federal Office for Civil Aviation. In respect of claims for damages up to 100’000 SDRs, we shall not avail ourselves of any defence in order to exclude or limit our liability. With regard to the portion of a claim exceeding 100’000 SDRs, we may be exonerated if we can prove that we and our agents have taken all necessary measures to avoid the Damage. In the case of aircraft accidents resulting in death or injury of passengers, we will make, within 15 days after the identity of the person entitled has been established, such advance payment to meet financial needs of that person. In case of death, such advance payment will amount to 15’000 SDRs per passenger. Such advance payments do not constitute a recognition of liability and may be offset against any amounts subsequently paid as damages by us.

Article 13: Time limitation

13.1 Time limitation on claims
Receipt by you of checked Baggage without complaint is prima facie evidence that the same has been delivered in good condition and in accordance with the contract of carriage. In the case of Damage, you must complaint to us forthwith after the discovery of the Damage, and, at the latest, within seven days from the date of receipt of the checked Baggage. In case of delay, the complaint must be made at the latest within twenty-one days from the date on which the Baggage has been placed at your disposal. Such notifications must be made in writing.
13.2 Time limitation on actions
Any right to damages shall be extinguished if an action is not brought within a period of two years, reckoned from the date of arrival at the destination, or from the date on which the aircraft ought to have arrived, or from the date on which the carriage stopped. The method of calculating that period shall be determined by the law of the court seized of the case.
Article 14: Miscellaneous

14.1 Choice of Law
Unless otherwise provided by the Convention or any applicable Law, this contract of carriage shall be governed by Swiss Law.
14.2 Choice of Jurisdiction
Unless otherwise provided by any applicable Convention or Law, any dispute arising out of this contract of carriage shall be subject to the exclusive jurisdiction of the Geneva (Switzerland) courts.
